Print Villa, a LLC company, will herein after be referred to as Print Villa, PrintVilla.com, We, Our, Us and other adjectives of the like.  All visitors of the PrintVilla.com website will herein after be referred to as You, Visitor, Client, and the like.  All design work referred to in this Terms of Use agreement includes clipart images, photographs, graphic designs, layouts and such.

Terms of Use:

Please read these Terms of Use of utilizing the PrintVilla.com website.  By visiting our website, you are agreeing to abide by these terms.  Print Villa reserves the right to alter any of the Terms of Use of our website at will and will always have the most current Terms of Use posted for your review on the Terms of Use page; this posting will serve as our official notification, electronic or otherwise, to you as a visitor/client of PrintVilla.com of our Terms of Site Use.  It will be your responsibility as a visitor/client of PrintVilla.com to visit the Terms of Use page on each visit and review the terms so that you are updated.

Copyrighted Designs Use Terms:

All product offerings by Print Villa, including but not limited to the interworking and/or design of our website, product clipart images, photographs, design layouts including font choices for a particular design, graphics and any other information pertaining to any particular design, are licensed to, and/or the royalty fees purchased for, Print Villa’s use only, and are not transferrable to you as a visitor/client of PrintVilla.com for your personal use, reproduction, distribution or copying.  Print Villa asks that you please respect the talent and work of the artists, photographers and designers on this matter as everyone should get paid for their work. 

Any and all special request designs or ideas that Print Villa may create on your behalf will become the sole property of Print Villa; we reserve the right to include said design, excluding your personal information of course as a new design offering and/or in promotional marketing materials and/or any other manner we see fit, with or without your permission and without gain to you, monetary or otherwise.  Although Print Villa makes every effort to make sure that we have acquired the appropriate license for use of the designs on our website and in our product designs, we make no claims or guarantees that the designs used will not infringe on the rights of an individual artist based on their guidelines; an example being that most artist require that the images are not used in defamatory or obscene ways. 

Some of the product offerings on PrintVilla.com will require a photograph from you, our client, an example being but not limited to a Birth Announcement; by submitting the photograph or artwork image for use in our production of your project, you, the client, are assuming full responsibility of the right to use the image.  If the said image requires permission or rights to be granted or an obtaining of a use license, you the client are agreeing that you are responsible for acquiring it and Print Villa assumes no responsibility for the use of the image while incorporating it into our project design production for you.

Use of Site:  

Print Villa reserves the right to make necessary alterations on any design, including but not limited to the font size, graphic image size, color, etc, to make your order item look its best.  As our client, you will be offered the ability to eproof these items for approval prior to the product being printed.

Print Villa’s goal is to keep our product and company fun and light-hearted and will work hard to satisfy our clients, we however feel that even a business relationship requires responsibility and accountability on the parties of both participants, buyer and seller; just as your green money is costly to you in these hard economic times, please keep in mind that our money is disguised as artwork on paper and time, and is just as costly.  We ask that you use our website in a respectable manner, while not trying to capitalize on another person’s work, or trying to defame another person, or violate another person’s rights, or by being obscene, harassing, libelous, slanderous, threatening, or in any other manner utilizing objectionable behavior and Print Villa reserves the right to terminate your use of our website based on the violation of those and any other Terms of Use rules.  Although Print Villa welcomes people of every walk of life to be a visitor/client of our site, included but not limited to their race, gender, religious/spiritual background, and their sexual lifestyle, we will not tolerate our visitors/clients and/or ourselves being mistreated or in any way subjected to unwelcome comments at any time.  Print Villa reserves the right to refuse to work with any person or business, for any reason, even if we have had a previous working arrangement; it is subject to termination at our will.

Spam and Personal Information Collected: 

PrintVilla.com will in no way send electronic solicitations to you the client without you having requested to receive such materials, including but not limited to requests of knowledge regarding upcoming events, art contest, sales event or new product offerings.  Although Print Villa offers a refer a friend section for ease of use to notify an acquaintance of a service/product that we offer, visitors/clients are not invited to spam/harass anyone else by using the service to offending levels.  Print Villa will never sell your personal information which is collected through our website to anyone for any reason; after all, we are human too and would not appreciate this violation of our privacy. 

Indemnification:

Disclaimer of Warranties:

Print Villa gives no warranties, expressed or implied, and in no way claims function to the merchantability that you will receive any business opportunities by the purchase and distribution of products such as an Entrepreneur Contact Card or a Sales Event Announcement or any other like materials created on your behalf.  We are in no way affiliated with the business license offices in any State and do not claim to know the rules and laws that govern them and strongly suggest that if you purchase a product such as an Entrepreneur Contact Card that you perform your own investigations as to any and all legal situations you and/or your company could find yourself a part of based on your distribution of those product offerings, including but not limited to sale tax payments.  We offer Entrepreneur Contact Cards simply as a convenient way for you to notify potential individuals of services that you will or can offer; we are not however responsible for verifying that you are skilled, trained, capable of or qualified for the position(s) in which you are marketing yourself or your business.  Print Villa will always use a reliable carrier such as USPS but makes no warranties, expressed or implied, as to the shipping delays of such carriers used on time sensitive orders; we only recommend that you allow yourself plenty of time for orders so that last minute delays wouldn’t ruin the occasion, as Print Villa assumes no responsibility, monetary or otherwise in this instance.

Payments and Fees and Refunds:

All products available on PrintVilla.com list their true accurate pricing, as you the client have the right to know.  There will be instances in which special project requests will and can be made, at which time we will evaluate a special price and/or any extra design fees incurred and notify you by way of a PayPal invoice so payment can be made.  Print Villa requires 100% upfront payment, including on special request designs; if however, an agreement cannot be reached between Print Villa and our client on a special project, we will refund the payment less any monies charged for design time, this amount will never exceed more than 50% of a total order and in most cases will not be that much.  Print Villa will only charge reasonable design fees and will always require your agreement to such fee(s) by electronic means prior to your project being created.  Your response by your listed contact email address will stand as your signature of agreement in these instances and you agree to be bound by this fact.  Once products have been ordered and agreed to, with or without your desire to participate in our eproof option, you are stating and taking responsibility of payment for the full order total.  If you, the client, choose to use the eproofing system that we offer for you to be able to view your finished product prior to printing and you fail to respond within 5 business days, Print Villa will assume the order is acceptable and the order will be printed and shipped and no refunds will be made.  If you place and pay for an order that requires you to submit a photo or art image to Print Villa and you fail to do so within 30 days, you will forfeit all monies paid to Print Villa.  Should you wish to make changes to an order prior to it being printed, including cancelling an order, you will be subject to a restocking fee of not more than 50% of the order total, as even though the order has not been printed, does not mean that work has not taken place such as typesetting and the staff needed to instigate refunds, again time is green money too.  Print Villa utilizes the services of nationally recognizable PayPal.com for payment collecting; as a client of PrintVilla.com there may be terms that you need to adhere to on PayPal’s behalf that we have no control over.

Timeframe of Order Productions:

Print Villa will make every effort to have your product through our production system within 2-3 days; should this timeframe need to be altered in any way for any reason, we will make every effort to contact you at the email address that you have provided to us.  Should your order be delayed in production for more than 7 days, you the client will have the right to notify Print Villa by email to cancel the order at no cost to you.  Please allow for a 5 day timeframe for us to present you with our special project design ideas for your first of three revisions; our design presentations will be delivered to you via the contact email address you have supplied us with, an approval email from that same contact email address will serve as your electronic signature for approval.

Order changes or cancellations:

Should you wish to make changes to an item prior to it being printed, including cancelling an order, you could be subjected to a restocking fee of not more than 50% of the order total, as even though the order has not been printed, does not mean that work has not taken place such as typesetting and the staff needed to instigate refunds, again time is money too. 

Design Creations Involving Customer Photos and Artwork:

Print Villa assumes absolutely no responsibility of how the quality of the photo/artwork you may send to us will look in the finished product.  Some designs require the image to be square and some rectangular.  Print Villa will work to edit your photos/artwork as best as possible to fit them into the required space allowed by the design, but if that particular image is simply too skewed, blurred or otherwise unusable  to work with properly, we will notify you.  Print Villa requests that you send high quality images, preferable 1200 DPI for the best possible finished product outcome; we can make no assurances to the print quality of a poor quality image.

Customer Requirements:

Although PrintVilla.com markets many items that consumers under 18 would wish to have, we require that you are at least 18 years old to make a legally binding agreement with us via our website; you may instead enlist the help of your parents or other 18 year old and above individuals to make the purchase on your behalf.  Print Villa reserves the right to refuse to work with any person or business, for any reason, even if we have had a previous working arrangement; it is subject to termination at our will.

Feedback and Suggestions:

For Print Villa to be able to grow as a company that is user-friendly and customer-oriented, we welcome any and all feedback, suggestions and ideas.  Any and all feedback, suggestions and ideas submitted to Print Villa electronically, will become the non-confidential, exclusive property of Print Villa.  As the property of Print Villa, any and all feedback, suggestions and ideas exchanged with us means you are transferring and assigning to us all of your rights, title and/or ownership to use the information in marketing materials, testimonials, designs or any other unrestricted use that may be beneficial to us, at no charge to us.  

Shipping and Handling:

Print Villa enlists only the best of carriers to deliver your products to you, such as USPS and we take as many reasonable precautions as possible as to the products being trackable or insured, however, we will not assume any responsibility in the carriers ability to deliver you within the timeframe they claim and therefore will not offer any discounts or refunds of an item not being delivered when the carrier claims. 

Print Villa is a limited liability company and subject to the governing laws of TN.
