Print Villa, a LLC company, will herein after be referred to as Print Villa, PrintVilla.com, Print Villa Designs, Print Villa Invites, Print Villa Invitations, Me, My, Mine, We, Our, Us and other adjectives of the like. All visitors of the PrintVilla.com website will herein after be referred to as You, Visitor, Client, and the like. All design work referred to in this Terms of Use agreement includes clipart images, photographs, graphic designs, layouts and such.
TERMS OF USE:
Please read these Terms of Use of utilizing the PrintVilla.com website. By visiting our website, you are agreeing to abide by these terms. Print Villa reserves the right to alter any of the Terms of Use of our website at will and will always have the most current Terms of Use posted for your review on the Terms of Use page; this posting will serve as our official notification, electronic or otherwise, to you as a visitor/client of PrintVilla.com of our Terms of Site Use. It will be your responsibility as a visitor/client of PrintVilla.com to visit the Terms of Use page on each visit and review the terms so that you are updated.
PROOFING INFO:
Proofs will be sent to you for review within 24 hours Monday-Friday. There will be 3 free edits that are not based on Print Villa errors.
You to be able to review a proof of your order prior to printing and if you fail to respond within 5 business days to that proof, Print Villa will assume the proof is acceptable and the order will be printed and shipped and no refunds will be made once printed. Approving the proof is your acceptance of responsibility of the product even if there is an error or typo so review it carefully.
PAYMENTS and FEES and REFUNDS:
Payments are made when the order is placed online. All products available on PrintVilla.com list their true accurate pricing.
Fees: Should you wish to cancel an order once a proof has been prepared, you will be subject to a cancellation fee of $15.00 to cover the expenses of time invested already and bank fees that we will incur from accepting/refunding the monies during the transaction. Some special requests could incur a fee which would be worked out and agreed to via email between you and Print Villa. Print Villa requires 100% upfront payment, including on special request designs; if however, an agreement cannot be reached between Print Villa and our client on a special project, we will refund the payment less any monies charged for design time, this amount will never exceed more than 50% of a total order and in most cases will not be that much. Print Villa will only charge reasonable design fees and will always require your agreement to such fee(s) by electronic means prior to your project being created. Your response by your listed contact email address will stand as your signature of agreement in these instances and you agree to be bound by this fact. If you place and pay for an order that requires you to submit a photo or art image to Print Villa and you fail to do so within 30 days, you will forfeit all monies paid to Print Villa.
Refunds: Due to the nature of our business, with the products being personalized specifically for you and your event, Print Villa does not offer refunds AT ALL once the product has been printed. If an error is noticed on the product after is has been printed, we will offer a reprint discount BUT if the order has shipped already, we will also require additional shipping to be paid at the FULL RATE (we only pay the extra shipping amount on the 1st time the order is shipped due to it being flat rate to you).
PRODUCTION TIMEFRAME
Print Villa will make every effort to have your product through the production system within 2-3 days; should this timeframe need to be altered in any way for any reason, we will make every effort to contact you at the email address that you have provided to us. Should your order be delayed in production for more than 7 days, you the client will have the right to notify Print Villa by email to cancel the order at no cost to you.
CANCELATIONS:
Should you wish to cancel an order once a proof has been prepared, you will be subjected to a cancelation fee of $15.00 to cover the expenses of time invested already and bank fees that we will incur from accepting/refunding the monies during the transaction. You are agreeing that this $15.00 fee will be deducted from the monies we refund to you if the order is cancelled for any reason after a proof has been prepared.
DESIGNS INVOLVING CUSTOMER PHOTOS:
Print Villa assumes absolutely no responsibility of how the quality of the photo you may send to us will look in the finished product. Some designs require the image to be square and some rectangular. Print Villa will work to edit your photos as best as possible to fit them into the required space allowed by the design, but if that particular image is simply too skewed, blurred or otherwise unusable to work with properly, we will notify you. Print Villa requests that you send high quality images, preferable 300 DPI for the best possible finished product outcome; we can make no assurances to the print quality of a poor quality image.
CUSTOMER REQUIREMENTS:
PrintVilla requires that you are at least 18 years old to make a legally binding agreement with us via our website. Print Villa reserves the right to refuse to work with any person or business, for any reason, even if we have had a previous working arrangement; it is subject to termination at our will.
USE OF SITE:
Print Villa reserves the right to make necessary alterations on any design, including but not limited to the font size, graphic image size, color, etc, to make your order item look its best. As our client, you will be offered the ability to eproof these items for approval prior to the product being printed.
Print Villa’s goal is to keep our product offerings and company fun and light-hearted and will work hard to satisfy our clients, we however feel that even a business relationship requires responsibility and accountability on the parts of both participants, buyer and seller. We will treat you with honesty and respect, please extend us the same courtesy. We ask that you use our website in a respectable manner, while not trying to capitalize on another person’s work, or trying to defame another person, or violate another person’s rights, or by being obscene, harassing, libelous, slanderous, threatening, or in any other manner utilizing objectionable behavior. Print Villa reserves the right to terminate your use of our website based on the violation of those and any other Terms of Use rules. Although Print Villa welcomes people of every walk of life to be a visitor/client of our site, included but not limited to their race, gender, religious/spiritual background, and their sexual lifestyle, we will not tolerate our visitors/clients and/or ourselves being mistreated or in any way or subjected to unwelcome comments at any time. Print Villa reserves the right to refuse to work with any person or business, for any reason, even if we have had a previous working arrangement; it is subject to termination at our will.
COPYRIGHT INFO:
All completed designs in this shop are the copyright of Print Villa. These designs are available for purchase when personalized for your one time event. Unauthorized use of these designs, mass production and commercial use is strictly prohibited. You do not gain the right to sell these designs nor profit in any way from them. The digital files are for a single event one time personal use.
All product offerings by Print Villa, including but not limited to the interworking and/or design of our website, product clipart images, photographs, design layouts including font choices for a particular design, graphics and any other information pertaining to any particular design, are licensed to, and/or the royalty fees purchased for, Print Villa’s use only, and are not transferrable to you as a visitor/client of PrintVilla.com for distribution or copying.
All designs on Print Villa are original with some incorporating the licensed clipart of other artists. None of Print Villa’s artwork, the final designs, nor the artwork we have licensed are transferrable; these images and final designs are not transferrable in their respective licenses or royalty fee uses to the visitor/clients of PrintVilla.com. Because the design licenses are not transferrable, you as a client of PrintVilla.com possess no rights to nor are able to make claims to any of the designs on PrintVilla.com, nor are they available to be trademarked by you or your company or on any personal level. Other clients of PrintVilla.com have the same legal use to the same or near same design that you have selected.
Any and all special request designs or ideas that Print Villa may create on your behalf will become the sole property of Print Villa; we reserve the right to include said design, excluding your personal information of course as a new design offering and/or in promotional marketing materials and/or any other manner we see fit, with or without your permission and without gain to you, monetary or otherwise.
Some of the product offerings on PrintVilla.com could require a photograph from you, our client, an example being but not limited to a Birth Announcement; by submitting the photograph or artwork image for use in our production of your project, you, the client, are assuming full responsibility of the right to use the image. If the said image requires permission or rights to be granted or an obtaining of a use license, you the client are agreeing that you are responsible for acquiring it and Print Villa assumes no responsibility for the use of the image while incorporating it into our project design production for you.
PRINTING COLORS:
Due to variances in personal monitors and printers, color variances may also occur.
TECHNICAL SUPPORT:
Print Villa does not offer tech support when printing the digital files. It must be assumed that if someone is purchasing an item that they are to print them self, that they have the knowledge to do so or knows someone whom does.
SPAM and PERSONAL INFO COLLECTED:
PrintVilla.com will in no way send electronic solicitations to you the client without you having requested to receive such materials, including but not limited to requests of knowledge regarding upcoming events, art contest, sales event or new product offerings. Although Print Villa offers a refer a friend link so you can tell a friend about an item/product design that we offer, visitors/clients are not invited to spam/harass anyone else by using the service to offending levels. Print Villa will never sell your personal information which is collected through our website to anyone for any reason; after all, we are human too and would not appreciate this violation of our privacy.
INDEMNIFICATION:
Print Villa is in no way responsible for your typos whether you choose to use the eproofing option or not and therefore no refunds will be made for this reason; Print Villa strongly urges you to use great care and proof reading when typing in the personalized text that you wish to have appear on your finished product. Some of the product offerings on PrintVilla.com will require a photograph from you, our client, an example being but not limited to a Birth Announcement; by submitting the photograph or artwork image for use for our production of your project, you, the client, are assuming full responsibility of the right to use the image. Print Villa utilizes the services of nationally recognizable companies including but not limited to Google Checkout, PayPal.com and the US Post Office; as a client of PrintVilla.com there may be terms that you need to adhere to with those companies that we have no control over.
FEEDBACK and SUGGESTIONS:
For Print Villa to be able to grow as a company that is user-friendly and customer-oriented, we welcome any and all feedback, suggestions and ideas. Any and all feedback, suggestions and ideas submitted to Print Villa electronically, will become the non-confidential, exclusive property of Print Villa. As the property of Print Villa, any and all feedback, suggestions and ideas exchanged with us means you are transferring and assigning to us all of your rights, title and/or ownership to use the information in marketing materials, testimonials, designs or any other unrestricted use that may be beneficial to us, at no charge to us.
Print Villa is a limited liability company and subject to the governing laws of TN.
